We are THE FRESH PRODUCE CONSORTIUM (U.K) Limited, a company limited by guarantee registered in England and Wales (registration no. 2721319). Our registered address is at Minerva House, Minerva Business Park, Lynch Wood, Peterborough, Cambridgeshire, PE2 6FT.
For the purposes of data protection law, we will be a controller of the personal information we hold about you. This means we make decisions about how and why your information is used and have a legal duty to make sure that your rights are protected.

2. WHAT INFORMATION WE COLLECT
In order to function as a consortium, we need to use personal information about the employees of actual and prospective FPC members. One of the main advantages of joining the FPC is its ability to connect members to one another so that they can share knowledge and gain insight. This would simply not be possible without using and sharing personal information.
The personal information we collect may include your name, e-mail address, telephone number, images and videos. If you provide us with a business card containing other personal information, we may also retain it. If you subscribe to the FPC Fresh Talk Daily newsletter located at www.fpcfreshtalkdaily.co.uk, you will be asked to give your e-mail address, which will be stored on www.wix.com. However, we will be able to access this through our third-party consultant.
How we use your information
We will only use your information with your consent, or because we need to do so in order to:
• enter into, or perform, a contract with you e.g. for membership;
• comply with a legal duty;
• for our own (or a third party’s) lawful interests, provided your rights don’t override these; or
• to protect your vital interests.
In any event, your information will only be used for the purpose(s) we collected it for (or else for a closely related purpose, such as record keeping). If you subscribe to our Fresh Talk Daily newsletter, we will not use your e-mail address for any other purpose apart from delivering the newsletter to your inbox.Our lawful interests include assisting FPC members to network with one another, gathering industry insight and contacts, and facilitating profitable commercial relationships.
Sharing information
We will never sell or trade your personal information. Once you are an FPC member your company details will appear on our website in the 'members listing' using the company information submitted by you at time of application. If you wish to amend this or be removed from the members list, please email info@freshproduce.org.uk.
We may disclose it to members of FPC’s technical or regulatory groups where appropriate e.g. where a government department or agency seeks input from the industry when developing policy. This may include sharing your information with an organisation which is not a member of FPC. We may also disclose your personal information in response to an inquiry from another FPC member e.g. where one member would like to make contact with another that trades in similar products, in order to establish a mutually beneficial commercial relationship. This ability to network represents a key benefit of becoming a member of the FPC. If we do disclose personal information about you, we will do so in a way which is proportionate and respects your privacy to the greatest possible extent.
We also will share the personal information of those individuals who attend our events, but only the information which is absolutely necessary in order to confirm their attendance and cater for any dietary requirements they might have. All the suppliers we use will only be allowed to use the information for a specific purpose and there will be a written agreement which makes sure that it is legally protected. Prior to each meeting, we will circulate a list containing the names and organisations of all delegates who have indicated that they will attend, but no contact details or other personal information will be included.
We may share your personal information with our subcontractors as part of the work they do for us. However, they will be contractually bound to keep it confidential.
Sensitive information
We do not normally collect or process sensitive personal information about our members or their employees, (such as information about someone’s health or beliefs). In the unlikely event that we do (for example, if an accident occurs at one of our events), we’ll ensure that this information is kept private and secure.

We may collect non-personal information about visitors to our website as this helps us optimise and improve it. This information might include your internet protocol address, the browser being used to connect to our website, the device (e.g. its operating system) and the connection type (e.g. the Internet service provider used). However, none of this information will directly identify you.
Cookies
As is common practice with almost all professional websites this site uses cookies, which are tiny files that are downloaded to your computer, to improve your experience. This page describes what information they gather, how we use it and why we sometimes need to store these cookies. We will also share how you can prevent these cookies from being stored however this may downgrade or 'break' certain elements of the site’s functionality. Our website may contain hyperlinks to third parties. We are not responsible for the content or functionality of any of their websites. If an external website requests personal information from you, the information you provide will not be covered by this Policy. 4. COMMUNICATIONS
If your organisation becomes a member of the FPC, we may contact you by email, telephone, or post with information about upcoming events or news about other FPC activities which we think may interest you.
Email marketing
We will only contact you personally with email marketing communications if your organisation is an existing FPC member, if you have asked to receive marketing, or have enquired about a particular service.
Changing your preferences or unsubscribing
You can change how you hear from us or unsubscribe from marketing at any time by clicking the “unsubscribe” link on any of our emails, or by contacting us using the details given in section 1 above. You can also contact us using these details if you wish to complain about a marketing communication you have received in error.
5. KEEPING YOUR INFORMATION SAFE
We employ a variety of physical and technical measures to keep your personal information safe and to prevent unauthorised access to or use or disclosure of it. Electronic data and databases are stored on secure computer systems, and we control who has access to them (using both physical and electronic means). We have a set of detailed data protection procedures which our staff are required to follow when handling personal information.
Where we have given you (or where you have chosen) a password which enables you to access certain parts of our website, you are responsible for keeping this password confidential. We ask you not to share a password with anyone. We cannot absolutely guarantee the security of the internet, external networks, or your own device, accordingly any online communications (e.g. information provided by email or through our website) are at your own risk.
6. STORAGE
We only store personal information as long as it is required for the purpose(s) we collected it for (or for a related compatible purpose, such as keeping a record of an organisation’s membership). We regularly review the data we have and delete that which is no longer necessary. In certain situations, you have the right to request that data about you be deleted (the right to be forgotten), please see section 9 for further details.
If you believe that any information, we are holding about you is incorrect or incomplete, please contact us using the details set out in section 1.
7. DISCLOSURE OF YOUR PERSONAL INFORMATION
We may disclose your personal information to third parties:
in the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets;
if THE FRESH PRODUCE CONSORTIUM (U.K) or substantially all of its assets are acquired by a third party, in which case personal data held by it about its members and employees will be one of the transferred assets; or
if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use and other agreements; or to protect the rights, property, or safety of THE FRESH PRODUCE CONSORTIUM (U.K), our members or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.
8. INTERNATIONAL TRANSFERS
Except as set out below, we normally only store personal information within the European Economic Area (EEA). If one of our subcontractors (such as a payment processor) needs to transfer it outside of the EEA then we will take steps to make sure adequate levels of privacy protection, in line with UK data protection law, are in place. These safeguards will usually be contractual and/or the result of a European Union decision which allows the transfer (for example, a US organisation which is certified under the EU-US Privacy Shield framework).
We use MailChimp, an e-mail management system based in the USA, to manage and send email communications. This may mean your information has been transferred to the USA. However, MailChimp is certified under the EU-US Privacy Shield Scheme, and your information therefore remains protected.
As mentioned above in section 2, we use www.wix.comto manage subscribers to the Fresh Talk Daily newsletter. www.paper.li is a Swiss company, and Switzerland has been certified as a safe country for data transfers – so your personal information remains protected.
9. YOUR RIGHTS
We want you to remain in control of your personal information. Part of this is making sure you understand your legal rights, which are as follows:
(a)where your personal information is processed on the basis of consent, the right to withdraw that consent;
(b)the right to confirmation as to whether or not we are holding any of your personal information and, if we are, to obtain a copy of it;
(c)from 25 May 2018, the right to have certain information provided to you in a portable electronic format (where technically feasible);
(d)the right to have inaccurate information rectified;
(e)the right to object to your information being used for marketing or profiling, or on the basis of our or a third party’s legitimate interests;
(f)the right to restrict how your information is used; and
(g)the right to be forgotten, which allows you to have your information erased in certain circumstances (though this is not an absolute right and may not apply if we need to continue using it for a lawful reason).
